Nick's legal analysis is as always totally off the mark.
It doesn't stand up to the slightest amount of scrutiny.
  • while he knows they're fake voices, it's not guaranteed that his chat does (and they're dumb as rocks, so they're more likely than the average person to be fooled)
  • if the service is illegal, that doesn't absolve him of knowingly using an illegal service
  • if he has to make choices in the platform to decide which voices are used, or has requested that a particular voice be made (how curious that Sean's voice is there...), that would prove his personal involvement
  • he says it becomes questionable if the voice purports to be someone - okay, what if someone styles their superchat in this way? Then Nick even admits that it's illegal

Anyone affected will need to issue a C&D directly to Melton. Its hilarious how Supertips' TOS directly complies with NRS §597.810 but yet both Nick and Melton have wilfully breached it without reprimand.

Falsely striking is gay and cringe. If someone has a legit reason to do it it kind of on the violator. The issue is the system can be abused too much and you really can't tell if it's legit or not a lot of the time.
 
For anybody looking for more lawyers to watch on Youtube that aren't complete shitbags, John Bryan, aka The Civil Rights Lawyer, just hit 1 million subs.

He doesn't do trial streams, but he does excellent breakdowns of law enforcement encounters while harboring a suspicion of the government (in a rational way, and not an insane Nick or Barnes like way). I think @Potentially Criminal knows him and is also a fan.

Yeah. One classic mistake some people make on probation is abusing their prescription drugs and getting more of those drugs off the street.
Or assuming their obvious drug-seeking behavior won't be noticed and their Dr. Feelgood won't end up busted. Except even most addicts are not stupid enough to broadcast their crimes to the public like Nick does.

I do think there may be some legality about using someone's voice for profit as opposed to parody. As the draw to this is specifically you can use this person's voice for a price, but that would be a huge shitshow trial.

Yeah. IANAL, but I mean, can I start selling albums with AI generated music trained exclusively on Metallica and marketed under the name Metallica? Sean and Aaron make their living with their voice, and now it's been hi-jacked in a way that makes it more difficult for them to utilize their own likeness going forward.

It's the same reason I can't take a photograph and then create a statue based on the photograph as I've now infringed upon their right to make that statue. If Sean or Aaron decide "hey, I want to use my likeness for AI voice generated donation alerts!" they now have to unfairly compete with someone who has undermined their right to use their own likeness in this capacity.

There's producing a parody that draws from their likeness, and then there's charging a premium for the privilege of utilizing that likeness for customized voice messages. Its use really doesn't seem fair and it implies that those people gave their blessing for their likeness to be used in this manner.
