I'd say if you just used a likeness with a clear indication that it was parody, with no commercial intent, it would almost certainly be protected.

However, there is no such clear indication of parody, and how can Pedotips claim parody when they're not even the authors of what is said with the AI voices? What MAPton is doing is directly selling access to the likenesses of other people who did not consent to it. The only purpose of it is commercial.

Copyright does not directly protect such a thing, but right of publicity (a different right based on dignitary and privacy interests as well as economic) exists to protect people's use of their public image, likeness, or other identifying feature (such as their voice), whether for falsely portraying them as endorsing something or otherwise.

The penalties are generally being forced to disgorge the illicit profits, attorney's fees, and any other appropriate damages, including punitive damages, as well as an injunction against further tortious misuse.

I won't get into defamation or copyright. I think they're both weak, but there's probably enough of a copyright argument there that a DMCA wouldn't be frivolous, and while DMCA is gay, what's good for the duck is good for the cuck, and Nick's gone down that road so has no room to complain (but he would).

Then there's the additional issue of what YouTube would think if some pedo is running a platform specifically to divert income from YouTube to himself, and on top of that, the platform is fueled by harassing other YouTubers.

Sean, I suggest you wait until after he loses the Monty lawsuit and then publicly declare that you're suing him for copyright infringement. You don't even have to commit to the legal action; just wait until he's in another financial hole and then scare him with another potential money drain.
