Just as a recap, this entire case is based on contributory infringement: that by supposedly not taking down the Google drive link, Null is encouraging people to infringe on Greer's copyright.

Russell has tried to stretch it by saying unless Null censors any, every, and all discussions about Russell, he (Null) is encouraging users to infringe on Russ's copyrights. This is nuts for several reasons.

1. First, Null has made it very clear the Kiwi Farms isn't a piracy website and won't host infringing material, and I'm certain there are several incidents in the site's history to back it up.
2. Second, Russell, as an author, songwriter, human rights advocate, and celebrity litigant, is a public figure. As such, he will be discussed, and since he has a bad habit of deleting his online musings, they must be preserved at least in part to actualize any discussion.
3. Third, if he's so angry about the infringement, he can just DMCA Google. They're very good about honoring those.
4. Fourth, this case has been complicated because the work in question was originally given away for free. Several users downloaded copies and used that Google drive link to circle it among themselves. We have posts from that era to prove it, and it should be trivial to ask Amazon for records about the book.

Russell should not be bringing up Kiwi Farms' character in the first place. It has literally nothing to do with this case. If the judge was in any way not retarded, he would've smacked it down from the outset and sanctioned Russell for continually bringing it up and wasting everyone's time.

I'm not a lawyer and Hardin has a better idea of how to handle this than I do, but I would not bring up Russell's character except to show he has a habit of engaging in ad hominem attacks when he doesn't get his way.

I know it's tinfoil hat territory but

it's my feeling that's exactly what the district judge is aiming for. He wants to put Greer in front of a jury because that's the only way Ratmouth wins this case. Melonhead can go on the stand and cry his tears, pledge his plights and wail away about how the ebil kiwi farms destroyed his life. And chances are the females on the jury will just say "fuck the facts, that boy ain't right and making fun of him is mean" and blamo! Greer walks away with a 100K.

The only way Greer walks away from this case with anything less then massive sanctions and legal fee's is if he gets to yammer away about his plights and how Jersh is just a big meanie to a jury of sympathetic women. And in my paranoid mind that's exactly what this district judge is trying to make sure happens.

Why has Hardin not realized that when Greer says he'll have something done today what he really means is somewhere between two hours and two weeks after the deadline and that the court has already ruled that this is really okay. I'm sure the judge will find some excuse to reduce whatever reasonable amount of sanctions should be awarded, but Greer suffering death from $1,000 paper cuts is still funny.

As nice as it is to see Hardin throwing some jabs, the best part of this flurry of legal filings is that Greer will respond them and in a hereto unimaginably retarded fashion. If he publishes his own emails that he marked as confidential (glad to see he finally read the protective order) as an exhibit my sides may never recover. Either way I eagerly await Russ's explanations.
