Hardin had to expend a ton of effort over months to attempt to get Russell to comply with basic discovery- meet and confer, disclosures, witnesses. The fact the witness issue ended in a late, completely inadequate disclosure of two irrelevant witnesses that wanted nothing to do with the case and pulled out before deposition doesn't moot anything. The damage (and billing) has already been done.

Hardin did Shitlips a favor, with moving past the witness fiasco yet here the drooltard is, trying to moot his way out of all culpability. Entitled pricks like Greer deserve to lose. Pronto, even.

Can Hardin/Null just send the check to the address listed on the docket and that be enough for the court?

You know, the address that is not Russ's that he's refused to update for years?

It's not been confirmed if it actually was already paid or not. There are several possiblities I can think of

The first time russtard asked to be paid he said to send the check to the scum at the DJF. I think it's entirely possible THE HARDSHIP sent a check to the DJF and they simply kept it because it was a costs award and they were working pro bono (do you think rusty read everything he signed when they showed up?). From there the DJF never mention it, drop russ like a hot potato after they win the appeal, but Mr. Mobius is still waiting for "his" money.

There's also the possiblity that all the awards and such are added up when this ends in 2035 and there's only a net payout. I'm not a lawyer so idk if that's usually how it goes but that idea seems reasnable to me. If you imagine a case where you're bouncing money back and forth constantly but at the end it nets out to 0 it's just a waste of everyone's time. So it might've never been paid but it's not supposed to be.

Sometimes the simple answer is the truth. Who is to say russhole didn't just forget he got paid. It's been literally years. And so on. I have a few more thoughts but I wouldn't want to tip rusty off.

Correct me if I'm wrong, but since Russ is suing Josh's LLC, I believe that Null is prohibited from representing it himself in court and is forced to hire a lawyer. I'm sure that the judge would be aware of that requirement.

Yeah Rule 37 doesn’t talk about sanctions being mooted by compliance. It only talks about failure to disclose or comply with court orders being sanctionable. I can find no case saying that compliance moots any discovery sanction, which makes sense because the failure itself is one of the problems being punished. That failure is not mooted by future compliance. Otherwise everybody would refuse to comply and then do it just moments before sanctions are imposed months later, saying “you can’t touch me judge, I complied eventually and mooted all the issues caused by me fucking with the court haha”.

Already said multiple times, but 'Coming to an agreement after I broke the rules' is not technically valid. It is a bit like a child making up their bed after getting a punishment to not doing it.

The judge might buy it though if it makes his life simple. I hope he is getting tired of dealing with Russ, though.

So is this really it? The evidence of contributory copyright infringement that he must provide, but still refuses to, are examples of people making fun of him? Does anyone know if he's ever actually disclosed anything to Null or he just described what he refuses to disclose and left it at that?

You have to wonder why, in all the years this has been going on, he never got the OK from his "witnesses," knew they didn't want to be involved, didn't even tell them he still planned to call them, knew they have nothing to offer about the supposed infringement and only wanted them presumably for damages claims for claims no longer a part of the action, and yet still listed them. Imagine trying to control your own witness who doesn't want to be there, has no info as to the claims, and is as likely to say you're batshit and have always been dramatic and litigious as to say anything remotely relevant or useful.

Russ's argument for settling is a combination of "settle because I'm tired of the case!" and Lord Humongus "just walk away and there will be an end to the horror." It's obviously an extremely strong argument, and the only reason Null hasn't taken it yet is because he's aligned with the Hitler picture senders and wants nothing but to harm Greer. This is evidenced by him not giving Greer everything he wants the second Greer whines about his plights. Only a Hitler aficionado would do such a thing.
