So im not exactly sure how to say this without powerleveling to the moon and back, but I actually work in collections (big suprise amirite?) at the bank thats suing her.

If Capital One is suing her, shit has absolutely hit the fan. We literally have like 5 different safeguards to make sure people dont get sued.

Like, we even have a thing where you can just promise to pay at a certain date and we wont sue you. You have to be a class A exceptional individual to actually press C1 this far.

I think people get a little too gunshy about powerleveling. Offering some pertinent and useful expertise while giving a simple explanation of why you're in a position to speak as such shouldn't be considered to fit the definition.

Alright then, ive lurked a long time but only started actively posting recently, so im still not sure about all the etiquette.
 
It reminds me that someone mentioned at some point Barb said she was 'too smart' for the banks.

Yet it's probably the equivalent of stuffing all your debt notices into a storm drain and hoping the problem goes away.

Makes you wonder how far this goes back.

I wouldn't be surprised if barb fell for some sov-cit level nonsense about how to get out of lawsuits like a champ. She's the exact type of person who falls for that shit, an entitled paranoid redneck who's kind of dumb and thinks they're better than everyone else.
 
Capital One is one of the lowest tier credit cards you can get. It's readily available and, if I remember right, the interest is way higher than most cards. It's literally what you get when you have bad credit and can't climb out of the hole but then drown in Capital One's own interest rate.

She's smarter then doctors have more financial knowledge then banks and she is a decedent of British royalty that Barbara Ann is quite the catch
 
Lets say I live in Europe (without giving too much personal details). Where I live someone's debt is considerate a asset/ property (whatever you name it). However it's a negative one. So the one who's going to inheret the deceased's 'property' has to choice either to accept or deny it.

I've heard of that before in some Eastern European countries. It's very bizarre.

The amount must be a bit high.. Captial One would not most likely waste time with something under 10,000 I would think.

Nah, Capital one sues more than any other bank and is notorious for suing to recover small amounts.

She can reasonably ignore them. Even if they win, which they probably will, by default, which they also probably will, and even if they get a judgment, which they probably will, she can probably ignore it, which she probably will, and then if they get real uppity, which they probably will, and send in collectors, which they probably will, they will show up to try to collect, and will run away screaming when all there is in the Chandler home is piles of endless flammable garbage.
 
If Barb has has no history of failing to pay bills or failing to take care of the finances in the past ("past" as in her 20s to the time Chris was about 20), then this is easily a sign of the progression of her dementia.

(More on-topic edit): So what's the deal here legally? Surely you can't expect a woman with dementia to pay some crazy ass debt, and you can't give it to her next of kin... Who foots this bill?
 
How long do you even have to go without paying your debts to get sued?
You can be sued pretty much any time after you stop making payments. Virginia has a 6 year statute of limitations on both written contracts and open ended accounts. Not sure if you can legally bring cases beyond the statue of limitations in Virginia, but other states have barred such suits. Not every debt will result in a lawsuit. Debts that aren't collected are normally sold off for pennies on the dollar and the buyer will bring a lawsuit hoping for a default judgment when the debtor doesn't show up in court.
Someone like Barb is a reasonable target for lawsuits like this, as while she isn't exactly in great financial shape, she does have an income of sorts and they might be able to squeeze something out of her.
I don't know Virginia law and don't feel like looking it up, but I would imagine Barb's income and assets are exempt from execution or close enough to all being exempt. Chris is legally differently-advantaged. Barb is elderly. They are poor as shit.
